Use of the Service does not establish a physician-patient, clinician-patient, pharmacist-patient, educator-patient, therapist-patient, fiduciary, or other professional healthcare relationship between you and 123Sugar, any physician or healthcare professional appearing in 123Sugar content, any contributor to the Service, or any person affiliated with 123SUGAR.COM LLC.This remains true even when:content is written, reviewed, presented, narrated, or discussed by a licensed physician, pharmacist, diabetes educator, nurse, dietitian, or other healthcare professional;you submit a question, comment, quiz response, survey response, message, or other communication;a healthcare professional responds to general educational content or participates in a community feature; oreducational material discusses symptoms, medications, laboratory values, medical devices, or treatment strategies.Communications sent through the Service are not medical consultations and should not be treated as confidential communications with your healthcare provider.123Sugar does not undertake a duty to review information you submit for medical significance or to warn you about a potential medical condition.

3. NOT FOR MEDICAL EMERGENCIES OR URGENT HEALTH CONCERNS

Do not use or rely upon the Service for a medical emergency or urgent medical concern.The Service and its email addresses, forms, community features, social-media accounts, and other communication channels are not continuously monitored for medical emergencies.If you believe you or another person may be experiencing a medical emergency, call 911 in the United States or the applicable emergency number in your location, or seek immediate emergency medical care.Do not delay seeking professional care because of something you viewed, read, heard, or interacted with through the Service.

4. ELIGIBILITY AND USE BY MINORS

7. USER ACCOUNTS

Certain portions of the Service may permit or require creation of a user account.If you create an account, you agree to:provide information that is accurate and not misleading;maintain the confidentiality of your password and login credentials;not permit another person to impersonate you through your account;promptly notify us if you reasonably believe your account has been accessed without authorization; andaccept responsibility for activity occurring through your account to the extent permitted by law.You may not sell, transfer, rent, license, or assign your account to another person.We may reject, restrict, suspend, or terminate an account when we reasonably believe it is being used fraudulently, unlawfully, abusively, in violation of these Terms, or in a manner that threatens the Service or other users.

Protect Your Personal Information

Moderation

Research Participation

Viewing ordinary educational material or agreeing to these Terms does not constitute informed consent to participate in a research study.If 123Sugar conducts or participates in research requiring informed consent, the applicable research process, consent documentation, privacy disclosures, institutional review requirements where applicable, and study-specific procedures will be addressed separately.Participation in research does not create a physician-patient relationship and is not medical treatment unless expressly established through a separate clinical relationship.

16. PRIVACY AND PERSONAL INFORMATION

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 123SUGAR.COM LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, LICENSORS, SERVICE PROVIDERS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, LOSS OF USE, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, OR SIMILAR LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.TO THE FULLEST EXTENT PERMITTED BY LAW, THIS INCLUDES CLAIMS ARISING FROM OR RELATING TO:RELIANCE UPON EDUCATIONAL CONTENT;MEDICAL OR HEALTH DECISIONS MADE BY A USER;FAILURE TO SEEK PROFESSIONAL MEDICAL CARE;USER-GENERATED CONTENT;THIRD-PARTY CONTENT OR SERVICES;UNAUTHORIZED ACCESS TO OR USE OF AN ACCOUNT;INTERRUPTION OR UNAVAILABILITY OF THE SERVICE;LOSS OR CORRUPTION OF DATA; ORERRORS, OMISSIONS, OR MISUNDERSTANDINGS OF EDUCATIONAL MATERIAL.TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF 123SUGAR.COM LLC FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:(A) THE AMOUNT YOU PAID DIRECTLY TO 123SUGAR.COM LLC FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(B) ONE HUNDRED U.S. DOLLARS ($100).THESE LIMITATIONS DO NOT EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. NOTHING IN THESE TERMS IS INTENDED TO WAIVE NON-WAIVABLE RIGHTS OR REMEDIES AVAILABLE TO A CONSUMER UNDER APPLICABLE LAW.

22. INDEMNIFICATION

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless 123SUGAR.COM LLC and its members, managers, officers, employees, contractors, agents, licensors, and service providers from and against third-party claims, liabilities, damages, judgments, losses, and reasonable costs and expenses arising from:your material violation of these Terms;your unlawful or unauthorized use of the Service;User Content you submit;your infringement or violation of another person's intellectual-property, privacy, publicity, or other rights; orintentional misuse of the Service.This provision does not require you to indemnify 123Sugar for conduct for which indemnification may not lawfully be required.

23. SUSPENSION AND TERMINATION

You may stop using the Service at any time.We may suspend, restrict, or terminate access to all or part of the Service if we reasonably determine that:you materially violated these Terms;your conduct creates a security or legal risk;your conduct threatens, harasses, or harms another user;your account is being used fraudulently or unlawfully;continued access could expose 123Sugar or another person to liability; orsuspension or termination is otherwise reasonably necessary to protect the Service.Where appropriate, we may remove User Content associated with a terminated account subject to our Privacy Policy, applicable law, backup practices, and legitimate record-retention requirements.Provisions that by their nature should survive termination—including intellectual-property provisions, warranty disclaimers, limitations of liability, indemnification obligations, dispute provisions, and general contractual provisions—will survive termination.

These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.Nothing in this section deprives a consumer of protections under applicable law that cannot lawfully be waived by contract.

Before initiating litigation concerning a dispute arising from these Terms or the Service, you and 123Sugar agree, where reasonably practicable, to attempt in good faith to resolve the dispute informally.A written notice of dispute to 123Sugar may be sent to yazanvwich@123sugar.com and should reasonably describe the nature of the dispute and the requested resolution.If a dispute cannot be resolved informally, then, except where applicable law provides otherwise, you and 123Sugar agree that any judicial proceeding relating to these Terms or the Service will be brought in an appropriate state or federal court located in the State of New Jersey, and each party consents to the personal jurisdiction of those courts.Nothing in this section prevents either party from seeking appropriate temporary, preliminary, or injunctive relief where necessary to protect intellectual-property rights, confidential information, security, or against imminent unlawful conduct.

123Sugar is operated from the United States.We do not represent that the Service or all Content is appropriate, lawful, or available for use in every country or jurisdiction.If you access the Service from outside the United States, you are responsible for complying with laws applicable to your access and use, subject to any legal obligations that independently apply to 123Sugar.Medical terminology, approved medications, device availability, clinical guidelines, emergency systems, and standards of care may differ between jurisdictions.
